A claim of double jeopardy under §19.2-294 of the Code of Virginia involves the question of whether the same act forms the basis for two separate offenses.
Even though the same act or acts is the underpinning for violations of both § 18.2-36.1(B) of the Code of Virginia and § 18.2-266 of the Code of Virginia, § 18.2-294 does not apply where one offense is a common law offense. Section 19.2-294 of the Code of Virginia only applies where two or more statutory offenses are involved.
